  • (A)

    General. Except as otherwise specifically provided by law, a person on a skateboard on a sidewalk, in a crosswalk or in an area open to the public has the same rights, duties and obligations as a pedestrian in such areas.

    (B)

    Unsafe operation of a skateboard. A person commits the offense of unsafe operation of a skateboard if the person does any of the following:

    (1)

    Operates a skateboard on a sidewalk or in an area open to the public in such a manner as to suddenly leave a curb or other place of safety and move into the path of a vehicle that is so close as to constitute an immediate hazard;

    (2)

    Operates a skateboard on a sidewalk or in an area open to the public and does not give an audible warning before overtaking and passing a pedestrian and does not yield the right-of-way to all pedestrians on the sidewalk or in the area open to the public;

    (3)

    Operates a skateboard on a sidewalk or in an area open to the public in a careless manner that endangers or will be likely to endanger persons or property; and

    (4)

    Operates a skateboard at a speed greater than an ordinary walk when approaching or entering a crosswalk, approaching or crossing a driveway or crossing a curb cut or pedestrian ramp and a motor vehicle is approaching the crosswalk, driveway, curb cut or pedestrian ramp.

    (C)

    Trespass on a skateboard. A person commits the violation of trespassing on a skateboard when the person operates a skateboard on or in any area open to the public or on or upon any private property when such area open to the public or private property is visibly posted with any sign indicating that skateboarding is prohibited on the premises.

    (D)

    Parental responsibility.

    (1)

    No parent, guardian or other person having the legal custody of a minor person under the age of 18 years may allow or permit the minor to be in violation of any provision of this section.

    (2)

    Violating parental responsibility under this section is a violation and, upon conviction, shall be punishable as established by resolution.

    (E)

    Operation of bicycles, skateboards, rollerblades and scooters.

    (1)

    No person shall operate a skateboard, scooter, rollerblades or bicycle on a sidewalk within the area bound by First and Fifth Streets and Main and C Streets.

    (2)

    Except as otherwise specifically provided by law, a person on a skateboard, scooter, rollerblades or bicycle on a sidewalk or in a crosswalk has the same rights and duties as a pedestrian on a sidewalk or in a crosswalk.

    (3)

    A person commits the offense of unsafe operation of a skateboard, scooter, rollerblades or bicycle on a sidewalk if the person does any of the following:

    (a)

    Operates the skateboard, scooter, rollerblades or bicycle so as to suddenly leave the curb or other place of safety and move into the path of a vehicle that is so close as to constitute an immediate hazard;

    (b)

    Operates a skateboard, scooter, rollerblades or bicycle upon a sidewalk and does not give an audible warning before overtaking and passing a pedestrian and does not yield the right-of-way to all pedestrians on the sidewalk;

    (c)

    Operates a skateboard, scooter, rollerblades or bicycle on a sidewalk in a careless manner that endangers or would be likely to endanger any person or property; and

    (d)

    Operates a skateboard, scooter, rollerblades or bicycle at a speed greater than an ordinary walk when approaching or entering a crosswalk, approaching or crossing a driveway or crossing a curb cut or pedestrian ramp and a motor vehicle is approaching the crosswalk, driveway, curb cut or pedestrian ramp. This subsection does not require reduced speeds for a skateboard, scooter, rollerblades or bicycle either:

    1.

    At places on sidewalks or other pedestrian ways other than places where the path for pedestrians or other non-motorized traffic approaches or crosses that for motor vehicle traffic; or

    2.

    When motor vehicles are not present.
