§ 12.04.200. Segregation of assessment lien; owner application.

(A)

Before any segregation of any assessment lien shall be made as provided in section 12.04.190, the owners of all property covered by the assessment for which segregation is desired shall file an application with the City Treasurer in such form as he or she may prescribe, which shall contain the following:

(1)

The description and assessment number of the original assessment;

(2)

The names of all persons having an interest in any portion of the property covered by the original assessment;

(3)

A good and sufficient legal description of each parcel after segregation, together with a statement of the amount of the assessment which is chargeable to each segregated parcel;

(4)

A statement that all owners waive all defects, jurisdictional or otherwise in the assessed proceedings and agree that said assessment shall constitute a lien on each parcel as the same may be segregated pursuant thereto.

(B)

The application shall be filed and acknowledged by all persons having any interest in the real property described therein.
