§ 12.08.030. Violating street or roadway; correction order; noncompliance deemed violation.

  • (A)

    If any street or roadway shall be constructed in violation of the terms of this chapter, the City Council may enter in the minutes of its proceedings an order directed to the person so violating this chapter directing that the violations be cured and fixing a reasonable time limit within which such reconstruction shall be accomplished.

    (B)

    Such order may be served upon the person to whom it is directed by personally delivering a copy thereof to him or her or by mailing a copy to the last known address of such party.

    (C)

    The failure of such party to reconstruct such street or road to comply with the standards herein established within the time fixed shall be deemed a violation of this chapter and each day such failure shall continue shall be a separate violation.
