§ 3.26.040. Funds in trust.

  • (A)

    On terms acceptable to the City Council, funds may be accepted by the City in trust for the maintenance, operation or performance of special services to certain sites or areas within the cemetery.

    (B)

    Each such trust shall, if accepted, be held separately from all other funds of the City, invested conservatively by the City Treasurer under the direction of the City Council in the manner prescribed by law for perpetual care cemeteries. The income from such trusts must be expended in strict accordance with the terms of each trust.

    (C)

    The records of each such fund shall be submitted to the Cemetery Commission annually for its examination and the review of the matter in which the same have been executed.
