§ 5.04.070. Umbrella licenses.

  • (A)

    Umbrella licenses cover those business activities of a similar nature leased, under concession to, or owned wholly or in part by a different person or persons on the same premises can be licensed under an umbrella license. The purpose of the umbrella license is to allow businesses with a small inventory of goods to combine their resources and inventory with other individuals of a similar nature.

    (B)

    Under an umbrella license the annual business license fee shall be paid and issued in the name of the business and not individuals.

    (C)

    Additions to the business license application must be made to identify employee/station/independent contractors if added after license was filed for current fiscal year.

    (D)

    An additional fee will be added to the license fee and must be paid for each employee, station, and/or independent contractor after the first three employees, consistent with the current business license code. A schedule of fees, fines and penalties is kept on file in the offices of the City for review.

    (E)

    Hair and nail salon fees are based on the number of stations available, not the number of stations currently filled. The same applies to spa/massage therapy offices and other professional services in which additional treatment rooms are available for lease.

    (F)

    Additional station lessees or independent contractors do not need to purchase a separate license. However, a business license application needs to be filled for each station lessee or independent contractor and submitted as part of the umbrella license.

    (G)

    Umbrella licenses as related to artists do not cover work that is sold, shown or advertised outside the scope of the umbrella license. Items and activities outside the scope of the umbrella license may include, but are not necessarily limited to websites, business cards, brochures, flyers or the like advertising themselves and not under the heading of the gallery which holds the umbrella license.

    (H)

    An example would be artists covered by one umbrella license for a gallery within Jacksonville who show their work in other places which is not an exhibit based out of the gallery for which the license was issued. To verify this, the Recorder may search records for other sources of advertising as needed which may include, but not be limited to the internet.

    (I)

    A separate business license and possibly a home occupation license if the business address is within the City limits of Jacksonville may be required for any such outside activity. For home occupation requirements see title 16 of the Land Use Code. All City regulations shall apply to both licenses.

    (J)

    Non-compliance of any licensure requirement may void the license immediately for all parties under the license.

    (K)

    In determining whether different activities on the same premises are related to the primary use within the meaning of this section, normal and ordinary customs and usages of businesses of like nature shall be considered and determined by City staff.
