  • (A)

    No one other than the owner of a gravesite, or the personal representative or heir of a deceased owner of, or the Sexton, shall set any monument, gravestone, structure, fence, railing or other work for the protection or ornament for any lot or parcel of ground in the cemetery; no one shall perform any such work or plant any trees, shrubs, ground cover or other vegetation without permit issued by the City bearing the written approval of the Sexton.

    (B)

    All such work shall be done under the direction and supervision of the Sexton. If by reason of a design, color, size or shape of any proposed structure or monument, the Sexton shall be of the opinion that the same may be offensive to average sensibilities or detract from the attractiveness or appearance of existing monuments and improvements, the Sexton shall have the right to submit the same to the Cemetery Commission for its decision and the decision of the Commission in that regard shall be final.

    (C)

    If the tree, shrub, grass, ground cover or other vegetation proposed to be planted is of such nature that the Sexton is of the opinion that it would be noxious, unduly difficult to control, dangerous, harmful or of such nature as to detract from the attractiveness or appearance of the cemetery, the Sexton shall have the right to refuse permission to plant the same and submit the same to the Cemetery Commission of its decision, and the decision of the Commission in that regard shall be final; and if the tree, shrub or grass is planted contrary to the decision of the Sexton or the Commission, the Sexton shall have the right to summarily remove it.

    (D)

    No tours of the cemetery shall be conducted without proper supervision of tour participants and notification to the City. The following information shall be sent to all school parties who wish to visit the cemetery in the form of a letter or email for the purpose of risk management:

    RE: Visits to Jacksonville's Historic Cemetery

    As your students and staff begin making plans for field trips we ask for your assistance in this very important matter.

    As a result of recent nationwide injuries and deaths resulting from falling grave markers, the City of Jacksonville is asking for your cooperation when planning school trips to visit our cemetery. We request that you plan ahead and follow these simple but important guidelines:

    Please contact the City of Jacksonville at 541-899-1231 or by email at recorder@jacksonvilleor.us to advise the City that you are planning a trip to the cemetery. Contact the City at least one week prior to the trip, notifying the City of the date, arrival time, number of students and the number of chaperones who will be present on site.

    Please have your students and their chaperons briefed about the dangers that exist within the cemetery grounds.

    The City requests that they not walk, stand, sit, lean on, or touch any of the grave markers, curbing, or other decorative cemetery fixtures.

    If you would like a cemetery representative to meet your group and provide a briefing for your students, we would be happy to arrange for that.

    Please request that your students use the walk ways and roadways and refrain from walking across gravesites.

    Ask that they walk and not run in the cemetery.

    Rubbings of any kind or not permitted in the Jacksonville Cemetery without prior approval. If approved, designated areas will be selected and activities will be supervised by a representative from the Cemetery.

    Please request that the chaperones accompany the students at all times while in the cemetery and closely monitor their activities.

    While these markers made of marble, granite and sandstone may appear solid and sturdy, many are quite fragile and loose on their bases, and some have decorative elements that may be loose. Volunteers work six months a year in restoring these markers but, in a cemetery that is over 150 years old with some 6,500 gravesites, the work is ongoing.

    (E)

    It is unlawful for any person to operate any motor vehicle at a speed in excess of five miles per hour within the boundaries of the Jacksonville Cemetery.
