§ 5.04.160. Event/special event permit issuance, conditions.

  • (A)

    The Recorder shall consider approval and issuance of the permit as provided in this chapter when, from a consideration of the application and from such other information as may be otherwise obtained, it is found that:

    (1)

    The conduct of said activity will not unduly interfere with routine traffic or pedestrian movement or endanger the welfare and safety of the public;

    (2)

    The conduct of such activity will not unduly interfere with the normal governmental or municipal operations, threaten to result in damage or detriment to public or private property or result in the City incurring costs or expenditures in either money for personnel or services which are not reimbursed in advance by the applicant;

    (3)

    The conduct of such activity will not constitute a fire and/or safety hazard and all prudent and reasonable precautions will be taken.

    (B)

    The Recorder shall give to the Mayor to consider approval and issuance of the permit as provided in this chapter when, from a consideration of the application and from such other information as may be otherwise obtained, it is found that:

    (1)

    The conduct of such activity will require the diversion of a great number of City personnel;

    (2)

    The conduct of such activity will unduly affect public health, safety or general welfare of residents or businesses in the area;

    (3)

    Alcohol will be served outside of the license area of OLCC permit holders;

    (4)

    Amplified music is requested outside of City Code allowances.

    (C)

    The Recorder and/or the City Council may seek additional input from the Planning Department regarding any aspect of the event. The Mayor, at their discretion, may refer any event to the City Council for formal approval.

    (D)

    All road closures require approval of the City Council.

    (E)

    All new OLCC licenses for events must be approved by City Council. Any pre-existing OLCC licensee may be approved by the Police Chief and/or the Mayor.

    (F)

    The decision of the City Council to issue, conditionally issue, or not issue a permit shall be final unless the applicant elects to request formal appeal rights to a hearing before the City Council at the next available meeting. To appeal, a written appeal request must be submitted within five working days of the date of the rendering of the appealed decision. An appeal fee shall be paid prior to being scheduled on the City Council agenda. A schedule of fees, fines and penalties is kept on file in the offices of the City for review.
