§ 8.08.040. Accumulation of materials constituting a fire hazard; notice to abate.

  • (A)

    No person shall permit or gather, accumulate, nor shall any person in possession or control of real property, materials or vegetation of any kind which in the judgment of the Fire Chief constitute a fire hazard.

    (B)

    The Fire Chief shall find that such an accumulation constitutes a fire hazard if the material thus accumulated is unnecessary to the reasonable use of the premises, exceeds the quantity of such material reasonably necessary for the use or occupancy of the premises, and that the accumulation is inflammable, in all the circumstances then existing, cause an unreasonable risk of fire damage.

    (C)

    A hazard not so removed within such time is defined as a public nuisance and shall be subject to abatement in the manner provided by sections 8.08.050 and 8.08.060 or punishable under section 8.08.100.

    (D)

    The continued use and occupancy of the premises after such notice has been given shall, if the fire hazard is not removed, be deemed a continued public nuisance, subject to injunction or punishable as a violation for each day during which such use or occupancy continues.
