§ 2.08.030. Right of entry for inspection purposes.

  • (A)

    For the purposes of performing their duties, the Fire Marshal or designated Deputy Fire Marshal shall have the right to enter upon any premises at reasonable hours for the purpose of inspection.

    (B)

    If any person or persons in lawful control of any part of any premises not open to the general public refuses to consent, or is not available to give their consent, to any such entry by the Fire Marshal, then the Fire Marshal may apply to any court of competent jurisdiction for a search warrant for that purpose.

    (C)

    The municipal court shall have jurisdiction and authority to issue such a warrant based on probable cause if the constitutional safeguards have been observed, and it shall be unlawful for any person to resist the lawful execution of any search warrant validly issued for the purpose of inspection under this chapter.
