§ 4.10.010. Purpose, composition, meeting frequency and qualifications.

  • (A)

    Purpose.

    (1)

    The City Council recognizes that policies must be formulated and implemented to provide a continuing solution to the growing problem of public vehicular parking in the City. A parking facility must be made available to members of the public to enable them to conduct their business efficiently and safely. The unnecessary use of a public street for vehicular parking causes unsafe, annoying and costly traffic congestion and deprives the public of the use of such street for its intended and primary purpose. The Parking Committee shall exercise its powers and duties to the end that the public shall be provided with safe and adequate vehicular parking facilities in the Central Business District. This will be done on an equitable and realistic economic basis and on such terms as will be fair and reasonable to all segments of the public.

    (2)

    The Committee shall have the authority, and it shall be its duty:

    (a)

    To develop and recommend to the City Council for approval, programs, projects and policies and changes therein:

    1.

    For acquisition, improvement and operation of motor vehicle off-street parking facilities to meet public requirements;

    2.

    For the development of all-day on-street parking facilities in peripheral areas and for temporary short-term parking facilities;

    3.

    For the enactment and administration of such business license surtaxes as may be needed to provide street parking and surtax revenues;

    4.

    For the funding of new or improved facilities; and

    5.

    For general policies concerning the parking of motor vehicles on public streets with the off-street parking district.

    (b)

    To hear and consider grievances, objections, remonstrance and suggestions from all persons affected by public parking policies or facilities within the off-street parking district and make its recommendations to the City Council regarding such issues.

    (c)

    To enact, promulgate or recommend fair and equitable regulations for the safe and proper public use and protection of the public off-street parking district of Jacksonville, including property leased, rented or otherwise held by the City. Such regulations shall be consistent with any ordinance or resolution of the City Council and shall relate to:

    1.

    Opening and closing hours;

    2.

    Parking time limits;

    3.

    Charges and fees, if any;

    4.

    Fines for violations of regulations;

    5.

    Classes of vehicles and other objects to be excluded in the public interest;

    6.

    Requirements that vehicles be operated within the traffic pattern and speed limits; and

    7.

    Parking in accordance with the markings established and placed by the City; and other similar matters.

    Such regulations outlined in subsection (2)(a)—(c) of this section shall be effective after they are duly adopted at a public meeting of the Committee and approved by City Council and filed on record with the City Recorder. Any such regulations may be originated, amended or repealed by the City Council. Unless amended or repealed, such regulations shall have the full force of ordinance and violations may be punished as provided in by section 1.08.010.

    (d)

    To conduct such hearings and make such administrative determinations as may be delegated by the Council, subject to appeal as provided by section 4.10.050.

    (e)

    To perform such other functions as may be specified by the City Council relating to the motor vehicle parking problem.

    (B)

    Composition and meeting frequency.

    (1)

    The City Parking Committee is established and shall consist of six members; four of whom must own, operate or occupy a business or professional premises in the off-street parking district; one member at large; and one Councilor as liaison who shall be a non-voting member.

    (2)

    A quorum of three voting members shall be necessary to conduct the business of the Committee.

    (3)

    The Parking Committee shall hold special meetings and sessions as it may deem necessary to the conduct of its business.

    (C)

    Qualifications. Qualifications are detailed in the composition portion of this section.
